Unfair Trade Practice? Prove it Under Section 337 (October, 2015)

Beau Jackson published an article in Law360 entitled "Unfair Trade Practice? Prove it Under Section 337."

On October 21, 2015, Law360 published an article by Beau averring that, although some labor unions and public interest groups fear the recent Trans-Pacific Partnership (TPP) agreement will lead to job losses for American workers, they have the opportunity to litigate the deal’s potentially negative impacts — specific instances of harm to U.S. markets caused by imported goods. This article, entitled "Unfair Trade Practice? Prove it Under Section 337", also argues that Section 337 of the Tariff Act of 1930, while best known as an intellectual property enforcement mechanism, exists to protect U.S. industries and the American public from a range of unfair acts.
