Customs - Retaliatory Tariffs Monday, July 20, 2009 The United States Court of International Trade (CIT) recently ruled Slip Op. 09-58 that retaliatory procedures by the United States Trade Representative (USTR) are terminated as an operation of law. This opinion also applies to other products on the "retaliatory list" and concerns retaliatory tariffs imposed by USTR on "EC Beef Hormones." In the above-referenced case, a toasted breads importer from Spain challenged USTR's right to enforce retaliatory tariffs and requested a 100% refund of those duties paid between July 2007 and March 2009. << view all Alerts and Bulletins
